Photography consent & release form

This Photography Consent Agreement (“Agreement”) is entered into by and between Rugged Shadows Boudoir, operated by Tommy Bagwell (“Photographer”), and the undersigned model/client (“Client”). This Agreement governs the terms under which the Client’s photographs taken by the Photographer may be used.

1. GRANT OF RIGHTS

The Client hereby grants Rugged Shadows Boudoir and Tommy Bagwell the irrevocable right and permission to use photographs taken during the Client’s photography session for any personal, social media, promotional, commercial, or other purposes. This includes, but is not limited to, the rights to use, reproduce, modify, display, publish, and distribute the photographs without any further compensation to the Client.

I do not grant permission to Rugged Shadows Boudoir to use images that contain my likeness for social media promotion, website display, promotional materials, product creation, art projects, or the sale of art, without prior consent from the model. I understand that these images will not be distributed, publicly shared, or published as part of promotional efforts unless explicit permission is granted by me at a later date.

I hereby grant permission to Rugged Shadows Boudoir to use images that contain my likeness for the purposes of social media promotion, website display, promotional materials, product creation, art projects, and the sale of art. I understand that these images may be distributed, publicly shared, or published as part of promotional efforts. This release is granted without any expectation of compensation and with the understanding that these images may be used in a variety of media formats.

2. PHOTO CREDIT
The Client agrees to provide proper photo credit to “Rugged Shadows Boudoir” or “Tommy Bagwell” when using any of the photographs on social media platforms or any other form of publication.

3. PHOTOGRAPHY FEE
The Client acknowledges that the photography fee agreed upon at the time of booking is non-refundable. This fee covers the time and talent of the Photographer and is payable prior to the photography session.

4. PHYSICAL PRODUCTS
Any physical products containing the photography, such as photo books and prints, purchased by the Client are non-refundable. Payment for these products must be made in full prior to the Client receiving the finished products.

5. NUDITY AGREEMENT
The Client confirms that they have agreed to full or partial nudity as part of their photography session, understanding the artistic nature of Rugged Shadows Boudoir’s work. The Client affirms they are over the age of 18 and consent to the inclusion of such content in their photographs.

6. COPYRIGHT AND OWNERSHIP
The Photographer retains all copyright and ownership rights to the photographs. The Client is granted a license to use the photographs as agreed upon in this Agreement but may not sell, assign, or otherwise transfer the rights to the photographs without the Photographer’s explicit written consent.

7. LIABILITY RELEASE
The Client releases and discharges Rugged Shadows Boudoir and Tommy Bagwell from any and all claims and demands that may arise out of or in connection with the use of the photographs, including but not limited to, any claims for defamation or invasion of privacy.

8. MISCELLANEOUS
This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter. This Agreement may only be modified by a written amendment signed by both parties.

9. GOVERNING LAW
This Agreement shall be governed by the laws of the jurisdiction in which Rugged Shadows Boudoir operates.

10. CANCELLATION POLICY
The Client agrees to provide at least 48 hours advance notice for any cancellation. If the Client cancels less than 48 hours before the scheduled photography session, the full photography session fee may be charged to the Client, due upon request. This policy is in place to compensate the Photographer for the potential loss of bookings and preparation costs incurred.
